Term of condition

• 1. I am 20 years of age or above to be applied for Nutrition Gel membership
• 2. After Nutrition Gel CO., LTD. approved agreements done with distributor, me, as a distributor will be given authorized to sell Nutrition Gel’s products legally with conditions and details as mentioned in the compensation plans. Furthermore, an approval of agreement will be under Nutrition Gel discretion only.
• 3. I have read compensation plans and policies for Nutrition Gel CO., LTD. Member and I agree to abide by all terms and conditions, compensation plans and policies including regulation, code of ethics, additional documents and changes in any documents that may occur in the future are considered covering in the agreements. This Agreement is deemed to be a collective contract including Remuneration policies, practices, compensation plans and ethical rules. Any approval or agreements made outside company provided document will take effect only when written and signed by Nutrition Gel CO., LTD. and me. The violation to any of the terms and conditions of the agreement or commitment that I have made with Nutrition Gel CO., LTD. may result in revoking membership or other penalties as consider by Nutrition Gel. If there are any inconsistencies presented between policies, practices, ethical rules and publication, all shall take latest versions of all documents launched by Nutrition Gel to be effective.
• 4. If I want to terminate the contract, I must submit a document to that state the intention to end membership directly to Nutrition Gel, The termination will be effective after Nutrition Gel received document from distributor.
• 5. As a distributor, I am legally not company personnel, partner, franchisee, a hedge fund or a sole dealer of Nutrition Gel. I am agreeing to take responsibility for every consequence regarding law or regulations came from my action. I am complied by every law; agreement and regulation apply upon me from doing business.
• 6. Nutrition Gel CO., LTD. May assist me to notice every relevant laws and regulations applied to company and myself. However, it is my responsibility to operate the business on behaves of mine to comply by law and regulation. Therefore, Nutrition Gel and its employee along with company representative will take no effect caused from my action and I will be the one holding full responsibility. In the meantime, I give in any claim or litigation for Nutrition Gel including company's employees. If I am (or anyone under my behave) misconduct or commit any careless action that caused damage to company asset and reputation, I agree to compensate for every damage by Nutrition Gel does not hold any responsibility, liability for claims, lawsuits, or debts due to negligence and sponsoring in any of my misconduct.
• 7. I am understood that only qualified distributor selected by Nutrition Gel CO., LTD. will be able to sponsor a new distributor. Nutrition Gel holds sole discretion to approve or reject this application without disclosing reason to public. If the application is not approved or rejected, Nutrition Gel including the consultants and employee shall not responsible for any action and everything committed under my behave or any relevant person related to me. And I give up the right to be a distributor to claim any benefit occurred from my actions or any other person related to me.
• 8. I understand and agree that Nutrition Gel CO., LTD. can approve or reject my application without any notice.
• 9. I understand and agree that distributor and downline cannot change to another sponsor without any approval from Nutrition Gel and the sponsor.
• 10. I understand and agree that distributor can have only 1 account. If company found out that any distributor have more than 1 account, only first account is consider to be valid and other will be terminate without prior notice.
• 11. I understand and agree that if company found out that my spouse, which also being a distributor and registered marriage license with mine have another account, the last account registered will be invalid and all downline will be moved to the first account instead.
• 12. I understand and agree that Nutrition Gel CO., LTD. will agree to pay compensation to me as distributor details as stated in compensation plan being submitted to the office of the Consumer Protection Board (OCPB)
• 13. I understand and agree that Nutrition Gel agrees to purchase the products, promotional materials manuals or business promotion equipment back from distributor under the condition that he/she must state the intention to claim the right prior directly to the direct sales business entrepreneur within 30 days from the date of receiving the products.
• 14. I understand and agree that Nutrition Gel CO., LTD. will purchase products, promotional materials, manuals or business promotion equipment which distributor purchased from Nutrition Gel CO., LTD. Back in the same price that was being purchased within 15 days from the date distributor state the intention to claim the right. However, if the period of claiming this right exceed from condition number 13, Nutrition Gel CO., LTD. can charge for every fee involved in buying back process and eligible to set-off any debt related to the contract that distributor bond to pay.
• 15. I understand and agree that I must provide complete information necessary to receive payment from the company. If I do not submit necessary information more than 1 year, company will assumes that you giving up the right to receive every form of income and benefits.
• 16. I agree to not change or adjust any of Nutrition Gel products in every aspect including outer box, package and packaging.
• 17. I agree and accept that I cannot be able to hand over, assign or transfer any rights to others without approval from Nutrition Gel. However, Nutrition Gel may grant or transfer the rights of this contract to others without asking for my approval.
• 18. I agree and understand that distributor cannot use name, logo or any property of Nutrition Gel CO., LTD. without asking for permission from the company in document form.
• 19. If any of terms and condition in this contract is found to be unenforceable or not consider being in effect legally, it will not affect others that are already in effect.
• 20. This contract is enforced under Thailand law. I agree that any disputes or attempt to form an agreement that may occur both related or unrelated to this contract will be conducted at courts in Thailand. The party that wins the case will receive compensation for hired lawyer, traveling fee accommodation fees as appropriate from the losing party.
• 21. I agree that claims of any kind, whether in violation of the contract or in any other case, Nutrition Gel and its employees along with representatives are not bond to responsible to any damage includes the loss of benefits from any claims by other distributor.
• 22. I confirm that all of the information in this application form/distributor agreement is complete and correct and I understand that providing false or misleading information may lead to application invalidity under Nutrition Gel consideration.
